Resolution – WBO Participant Complainant Glowacki

The present ruling stems from this Committee’s “Resolution” issued on Saturday, July 6th 2019, regarding an official complaint filed on Monday, June 17th 2019, by Promoter Mr. Andrew
Wasilewski on behalf of WBO Participant Mr. Krzysztof Glowacki concerning the WBO Jr. Heavyweight Championship Contest against Mr. Mairis Briedis held on Saturday, June 15th 2019, at the Arena Riga, Latvia, as part of the World Boxing Super Series (WBSS) Tournament Semi-Finals. This Committee ruled that though the resolution of said contest was substantially irregular the World Boxing Organization (WBO) was impaired to terminate, reverse or overturn the official bout result (TKO) due to lack of subject matter jurisdiction and such ruling lies within the jurisdiction of the local boxing commission the Latvia Boxing Federation (LBF). Lastly, this Committee set forth a forty-eight (48) hour deadline whereby the World Boxing Super Series (WBSS) Tournament Officials determine whether they accept or reject our ruling.

The WBO World Championship Committee having reviewed the referenced “Resolution”, having examined our WBO Rules and Regulations, their applicability, and enforcement in this matter, and having been fully advised in the premises, it is hereby determined as follows:

WHEREAS, on Monday, June 17th 2019, the WBO acknowledge receipt of email communication whereby Promoter Mr. Andrew Wasilewski on behalf of WBO Participant Glowacki filed an official complaint via email regarding the WBO Jr. Heavyweight Championship Contest against WBO Participant Briedis in light of the numerous error executed by the appointed referee during the bout and consequently, requested WBO Participant Briedis be disqualified and suspended. Lastly, requested that the official bout result be reversed and declared as a “No Contest”; and,

WHEREAS, on Friday, June 21st 2019, this Committee issued an official notice via email to all WBO Participants (Team Glowacki, Team Briedis, World Boxing Super Series Tournament (WBSS) Officials and the Latvian Boxing Federation) ordering all parties to submit no later than Monday, July 1st 2019, no later than 4:00 p.m. EST, any statements, affidavits, reports, summaries, compilations, press reports, or other evidence or documents which the affected WBO participants want the Committee to consider. The submittal requested including a clear and specific summary of response to it, reasons and arguments upon which it is based, with a clear statement from the Complainant of the relief the complainant sought and from whom and a response on behalf of Mairis Briedis to that complaint and the relief sought on behalf of Krzyzstof Glowacki, and shall have attached clear and legible copies of all documents, reports, precedents or other materials relevant to the request; and,

WHEREAS, on Thursday, June 27th 2019, the WBO acknowledge receipt of email communication by Promoter Mr. Andrew Wasilewski on behalf of WBO Participant Glowacki whereby he requested an additional one-week extension to comply with our June 21st 2019 order. This Committee granted said request and set forth a final submittal deadline for July 3rd 2019 at 4:00 p.m. EST; and,

WHEREAS, on Wednesday, July 3rd 2019, the WBO acknowledge receipt of email communication by Mr. Jacek Szelagowski on behalf of Promoter Wasilewski on behalf of WBO Participant Glowacki. Mr. Szelagowski sought WBO Participant Briedis be disqualified for the admitted deliberate and intentional illegal elbow committed against WBO Participant Glowacki and that such action ultimately led to the end of the bout in benefit of WBO Participant Briedis. Further argued that even if WBO Participant Briedis is not disqualified for the intentional elbow, he should be disqualified for actions in knocking WBO Participant Glowacki down again almost a full 10 seconds after the bell ending round 2, or for his corner being in the ring before the knockdown even if the punch after the bell was somehow ruled to be legal; and,

WHEREAS, all interested parties submitted their respective arguments and positions, all of which were carefully examined, reviewed and considered by this Committee accordingly; and,

WHEREAS, on Saturday, July 6th 2019, this Committee issued “Resolution” notifying all relevant parties whereby it determined that the proper forum with jurisdiction and authority to terminate, reverse or overturn the official bout result lied within the local boxing commission. Furthermore, ruled that the applicable rules and regulations governing the referenced contest are the World Boxing Super Series (WBSS) and therefore, the WBO Regulations of World Championship Contests applied supplementary. Lastly, the ruling strongly recommended that the winner of the “WBSS” Finals between IBF Jr. Heavyweight Champion Mr. Yuniel Dorticos and WBO Jr. Heavyweight Champion Mr. Mairis Briedis face WBO Participant and complainant Mr. Krzysztof Glowacki within one-hundred twenty (120) days following the completion of said tournament; and,

WHEREAS, Saturday, July 6th 2019, the WBO confirmed receipt of email communication by Mr. Chris Meyer on behalf of Comosa AG promotional company of the referenced tournament requesting a forty-eight (48) hour extension in order to examine and discuss this Committee’s ruling accordingly; and,

WHEREAS, Tuesday, July 9th 2019, the WBO confirmed receipt of an official letter issued by the President of the Latvia Boxing Federation (LBF) Mr. Andrey Akhmedov advising that neither Mr. Briedis nor Mr. Glowacki was licensed by said commission. Furthermore, rejected any responsibility with respect to the outcome of the WBO Jr.Heavyweight Championship Contest between the participants stated herein; and,

WHEREAS, Tuesday, July 9th 2019, the WBO President submitted a replied letter to the “LBF” President Mr. Akhmedov and advised that as of matter of Law, the WBO lacked subject matter jurisdiction to terminate, reverse or overturn the official bout result held under the jurisdiction and authority of the local boxing commission (LBF). Moreover, clarified that though the WBO Regulations of World Championship Contests governed the foregoing bout, it is the local boxing commission’s function to conduct and administer all professional boxing matches and therefore, they bear jurisdiction; and,

WHEREAS, on Monday, July 15th 2019, issued a final deadline to the “WBSS” Tournament officials whereby no later than Tuesday, July 16th 2019, no later than 4:00p.m. said officials accept or reject this Committee’s ruling dated Saturday, July 6th 2019; and,

WHEREAS, on Tuesday, July 16th 2019, the WBO confirmed receipt of email communication by Mr. Chris Meyer on behalf of the “WBSS” whereby confirming acceptance of this Committee’s ruling recommending the winner of said tournament facing Mr. Glowacki within the following one-hundred twenty (120) days; and,

WHEREAS, in light of the World Boxing Super Series Tournament officials’ accepting this Committee’s ruling, we strongly recommend the WBO Ratings Committee installing Mr. Glowacki at the number one (1) position in the WBO Jr. Heavyweight World Ratings for the month of July 2019 accordingly; and,

WHEREAS, this Committee adopts by reference any and all the conditions set forth in our July 6th 2019, “Resolution”; and

WHEREAS, this Committee bears authority and jurisdiction pursuant with the WBO Regulations of World Championship Contests to include any and all powers necessary
to accomplish the conditions set forth in our original “Resolution”; and,

WHEREAS, in accordance with our WBO Regulations of World Championship Contests specifically, Section. 1 (b), (c), respectively, in relevant, state as follows:

(b) The World Championship Committee shall have the following powers and discretion:
(c) “The above powers shall be interpreted to include any and all powers necessary, helpful or convenient to accomplish the purposes, policies and intent of these rules.”

WHEREAS, pursuant with the powers afforded to this Committee by our WBO Regulations of World Championship Contests and in accordance with the conditions set forth in our “Resolution” dated Saturday, July 6th 2019, this Committee determines that said ruling if final definitive and enforceable; and,

NOW, THEREFORE, BE IT RESOLVED by the WBO Championship Committee pursuant to the WBO Regulations of World Championship Contests as follows:

 

  1. The WBO World Championship Committee hereby orders that the winner of the World Boxing Super Series Tournament (WBSS) finals between IBF Jr. Heavyweight Champion Mr. Yuniel Dorticos and WBO Jr. Heavyweight Champion Mr. Mairis Briedis must face WBO Participant Mr. Krzysztof Glowacki within one-hundred twenty days (120) after the competition of said tournament.
  2.  This Committee also recommends the WBO Ratings Committee to install Mr. Glowacki at the number one (1) position for the July 2019 WBO Jr. Heavyweight Ratings accordingly.
  3.  This “Resolution” adopts by reference any and all the conditions set forth in the Saturday, July 6th 2019, “Resolution” and therefore are ruling today is hereby final, definitive and enforceable.

 

This is a final decision of the WBO Championship Committee. The affected WBO participant may appeal such determination to the Complaint and Grievance Committee as per Rule 34, which as per Rule 3(e) of the WBO Appeals Regulation, must be submitted in writing to the WBO President within fourteen (14) days of this decision as its sole and exclusive remedy.
